Family law encompasses such matters as divorce, child custody, child support modification, alimony modification, adoption, and voluntary termination of parental rights. Unlike criminal defense where the prosecution has the burden of proof, the party making the request has the burden of proof to advocate their own position. Further, these areas of the law are less black-and-white compared to many others. Judges often make legal decisions concerning children based upon what is in the child’s best interests.
